These Terms set out how WayFairer works, what you can expect from us, and what we expect from you. By using WayFairer (the website, dashboard, player app, or any part of our service), you agree to these Terms.
"WayFairer", "we", "us", and "our" means WayFairer Labs Ltd, a New Zealand company. "You" means a golf course, a course employee, a marshal, or a player using our service.

1. What WayFairer Is
WayFairer is a tool that helps golf courses understand pace of play and manage rounds. It includes:
A player app (GPS-based tracking during a round)
A real-time dashboard for marshals
Course analytics
Historical pace insights
WayFairer provides information only. We do not control play, make decisions for the course, or manage player behaviour.
Courses remain responsible for safety, operations, and decisions made on the ground.
2. Who These Terms Cover
These Terms apply to:
Golf courses using the WayFairer dashboard
Staff and marshals invited by a course
Players using the player app
Anyone using our website or services
Courses are responsible for making sure their staff and players understand and follow these Terms.
3. How Player Tracking Works
When a player starts a round:
The app collects GPS location around every ~10 seconds
The data is sent to the course's dashboard
Tracking automatically stops when the round finishes or the player leaves the course boundary
Players are not tracked off-course. Courses decide how they want to run tracking (e.g., one player per group or all players).
4. Information We Collect
We collect:
Basic player details (name or nickname)
GPS data during a round
Session information (hole progress, pace, timings)
Technical and performance data
Course setup information
Players do not need an account, email, or phone number to use the app.

5. What Courses Can See
Courses only see:
Players currently playing at their course
Live position and pace information
Session history and trends for rounds played at their own course
Behavioural patterns linked to an internal WayFairer ID
Courses cannot see:
Any player's history at other courses
Any other course's data
Personal information that the player did not provide
6. What WayFairer Can See
To operate the service, WayFairer may access:
Technical logs
GPS and session data
Course configurations and analytics
Diagnostic information
Only authorised staff can access this information. We use anonymised and aggregated data to improve the service and for product development. We do not market directly to players.
7. Fair and Responsible Use
You agree not to:
Track or monitor anyone outside a legitimate round of golf
Use the dashboard to intimidate, harass, or unfairly target players
Export or misuse raw GPS data
Gain access to areas of the system you're not authorised to use
Interfere with, reverse-engineer, or tamper with the service
Share staff logon credentials
Courses are responsible for managing their staff's access.
8. Our Responsibilities
We will:
Provide the service with reasonable care and skill
Use industry-standard security practices
Protect the data we hold
Maintain and improve the service over time
We may update or change the service at any time.
9. Security, Risk, and Third-Party Misuse
We use industry-standard security measures, but no online system is completely secure.
If someone gains unauthorised access to WayFairer, intercepts data, or misuses stolen information, we are not responsible for any harm caused by:
criminal activity,
hacking or cyber-attacks,
misuse of stolen data, or
actions outside WayFairer's control.
We are not liable if someone uses stolen or intercepted data to target, follow, harm, or disadvantage a player or course.
This does not limit our responsibility if:
we fail to take reasonable security steps, or
we breach New Zealand privacy law.
Players are responsible for keeping their devices secure. Courses are responsible for their staff's access and account hygiene.
10. Payments (Courses Only)
If a course subscribes:
Fees are charged as shown when signing up
Subscriptions renew automatically unless cancelled
Prices may change, but we'll give fair notice
Players are not charged for using the app.
11. Ownership and Intellectual Property
WayFairer owns:
The platform and technology
The analytics engine
System design and data structures
Anonymised and aggregated data
The WayFairer brand and trademarks
Courses own:
Their course configuration
Operational decisions
Session history from their own facility
No rights are granted beyond what is stated in these Terms.
12. Data Retention
We retain:
Raw GPS data for a short operational period
Session summaries and pace history for up to seven years
Anonymised and aggregated data indefinitely

13. Limitation of Liability
To the maximum extent permitted by New Zealand law:
We are not liable for indirect, consequential, or punitive damages
Our total liability in any 12-month period is limited to the total fees paid by the course in that period
Courses remain responsible for decisions made using WayFairer data
Players use the app at their own risk. Nothing in these Terms limits your rights under the Consumer Guarantees Act (if it applies).
14. Ending the Service
You can stop using WayFairer at any time. Courses can cancel their subscription at any time (fees already paid are not refunded).
We may suspend or end access if:
These Terms are breached
The service is misused
Continued access would create risk or harm
We will give reasonable notice where practical.
15. Player Account Deletion
Players with an account can request account deletion from within the app.
When an account is deleted, account access is permanently disabled and the user is signed out. We remove or anonymise account identifiers used for authentication and notifications (for example, email, linked OAuth identity, and active session tokens).
Some records may be retained where required for legal, security, fraud-prevention, and service-integrity reasons. Where appropriate, retained records are de-identified or aggregated.
16. Changes to These Terms
We may update these Terms from time to time. Significant changes will be highlighted on our website.
Using the service after changes means you accept the updated Terms.
17. Governing Law
These Terms are governed by New Zealand law. Any disputes will be resolved in New Zealand courts.
