Terms of Service
Clear, practical terms for clubs and golfers using WayFairer.

Welcome to WayFairer. These Terms govern your access to and use of WayFairer's products
and services, including our website, mobile experiences, APIs, and dashboards (collectively,
the "Service"). By accessing or using the Service, you agree to these Terms. If you are using
the Service on behalf of a golf club or organization, you represent that you have authority
to bind that organization to these Terms.

1. What WayFairer Does

WayFairer provides pace-of-play intelligence for modern golf clubs. Using players' own
smartphones and lightweight web technology, we estimate on-course pace and provide marshal
dashboards, alerts, and aggregated insights—without installing hardware. The Service relies on
voluntary participation by golfers and course staff, device sensors, and course-level
configuration to operate.

2. Accounts and Organizations

- Club accounts may invite staff and configure courses, tees, and policies.
- You are responsible for the accuracy of information you enter and for any activity under your account.
- Safeguard credentials; notify us of any unauthorized use.

3. Acceptable Use

- Do not misuse the Service (e.g., disrupt, reverse-engineer, scrape without permission, or circumvent limits).
- Do not use the Service to identify or penalize individual golfers; the aim is operational awareness and player experience.
- Comply with all applicable laws and obtain any notices/consents required for your use case.

4. Location and Device Signals

During an active on-course session, the Service may request device signals (such as coarse or
approximate location, motion, and timing) to estimate pace and hole progress. We do not track
golfers off-course, and signals are limited to the round window. Accuracy can vary due to
device settings, environment, or network conditions.

5. Subscriptions, Trials, and Fees

- Some features require a paid plan after a free trial. Unless otherwise stated, plans bill in advance and renew automatically.
- You can cancel at any time; cancellations take effect at the end of the current billing period.
- Taxes may apply. Fees are non-refundable except where required by law.

6. Data Rights and Privacy

Our Privacy Policy (/privacy) explains what we collect and how we use it. You retain
ownership of your content and club configuration. You grant WayFairer a non-exclusive license to
process your data solely to provide and improve the Service, including security, support,
analytics, and anonymized/aggregated insights.

7. Beta Features

From time to time we may offer early-access or experimental features. Beta features are provided
"as is," may change or be withdrawn, and may have performance or accuracy limitations.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted Service. We may modify,
suspend, or discontinue parts of the Service with reasonable notice where practical. We are not
responsible for outages or limitations caused by third-party networks, devices, or platforms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW,
WAYFAIRER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Pace estimates are just that—estimates—and should be
interpreted with reasonable judgment.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAYFAIRER SHALL NOT BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR
GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE
AMOUNTS PAID BY YOU TO WAYFAIRER FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING
RISE TO LIABILITY.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially
breach these Terms, with notice where reasonable. Upon termination, sections that by their nature
should survive will survive (e.g., Data Rights, Disclaimers, Liability, Governing Terms).

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms and update the "Last
updated" date. Material changes will be communicated by reasonable means. Your continued use after
changes take effect constitutes acceptance.
